This existing wall is considered legal nonconforming however to repair/rebuild it must be to same location and height. Any new wall location variations from the existing wall loses the legal nonconforming status and must maintain 4' in height per current code requirements. If tiering is not an option, then must explore a preservation easement adjustment to allow for the two tiers of 4' height or rebuild existing wall to same parameters with same heights/locations.
