The minimum side yard setback in the UR Zoning District is 8-feet to the primary structure. An attached deck is considered part of the primary structure.
The homeowner was previously and recently advised of the need for a property survey to establish with certainty where the existing house is positioned on the lot. Due to the close proximity of the proposed decks to the property lines, a property survey (Improvement Location Certificate, or "ILC") will be required before WP Zoning can approve these decks. The decks will be required to meet the 8' setbacks as prescribed by the adopted Municipal Code.
