Form-based code section 5.5.2.2 states - Section 7.5.1203(F) is not applicable in the Downtown Form-Based Zone. Existing or re-established legal non-conforming uses may be temporarily discontinued without risk of losing legal nonconforming status.
To expand on how this benefits the proposed new tenant – Carrier West was existing prior to the establishment of the form-based code in 2009 and therefore established their legally non-conforming status as a warehouse and distribution use at this location. There isn’t really any amount of time that would remove the rights of this use continuing in this location. While the future tenant would not be considered warehouse/distribution, their use type of light industrial is a less intense legal non-conforming use and staff has determined that they would be permitted to occupy the space based on criteria set forth in the City wide zoning code section 7.5.1203.C.
